INTRODUCTORY PROVISIONS 

These Terms and Conditions (hereinafter referred to as "Terms and Conditions") of Ing. Ivona Šuchmannová, registered at Amurská 847/5, 100 00 Prague 10, ID 71825525 and VAT ID CZ6755116918, registered in Business Register in MČ P10 oži/5219/2009/Jav/1003854/2, (hereinafter referred to as the "Seller") sets the mutual rights and obligations of the parties arising in connection with or on the basis of a purchase contract (hereinafter referred to as the "Purchase Contract") concluded between the Seller and another natural person (hereinafter referred to as the "Buyer") through the Seller's online shop, in conformity with the regulation  § 1751 par.. 1 law number 89/2012 code, Civil code (hereinafter only “Civil Code“). The online shop is operated by the Seller on a website located at www.spiralabeading.com (hereinafter referred to as the "Website"), through a website interface (hereinafter referred to as the "Shop Web Interface").

 

Article 1 General provisions

1.1 - These General Terms and Conditions apply to all contracts concluded by SpiralaBeading (hereinafter referred to as the Seller), unless the parties have expressly agreed otherwise in writing.

1.2 The provisions of these General Terms and Conditions may only be deviated from if this has been expressly agreed in writing and confirmed by both parties. 

1.3 By placing an order on the Seller's website, the Buyer agrees to the validity of these General Terms and Conditions and accepts them in full.

1.4 The Seller reserves the right to change these terms and conditions as necessary, the version from the date of ordering is always the valid one.

 

Article 2 Contracts/agreements/offers

 2.1 All offers are valid while stocks last.

 2.2 The Seller expressly reserves the right to change prices, in particular if this is necessary on the basis of (legal) regulations.

 2.3 The Contract is concluded when the order confirmation made by the Buyer is sent by e-mail to the e-mail address provided by the Buyer. The Buyer and the Seller expressly agree that a valid contract is concluded when using electronic forms of communication once this order confirmation is sent to the Buyer. To the extent permitted by law, the Seller's electronic files are hereby deemed to be evidence.

 

Article 3 Prices and Payments

 3.1 The seller is a VAT payer, all prices on this website are quoted for EU buyers inclusive of VAT and exclusive of shipping and administration costs unless otherwise stated or agreed in writing. For buyers outside the EU, prices are shown exclusive of VAT.

3.2 The amount of shipping and administration costs varies according to the weight of the order, taking into account the method of delivery and the costs involved. The buyer can see the shipping cost directly in the shopping cart before confirming the order.

3.3 Orders placed via the website can only be paid in advance - the seller accepts Paypal payments.

3.4 Shipment of the goods is only after full payment of the price of the goods including transport. Until dispatch, the goods are the property of the seller 

3.5 Buyers are responsible for any customs and import taxes that may apply. Sender is not responsible for delays due to customs. 

 

Article 4 Goods and Delivery

4.1 Goods listed on the website as IN STOCK are in stock.

4.2 Digital products are sent to the buyer's email within 48 hours of payment of the order.

4.3 Physical goods are sent from the Czech Republic by the carrier Czech Post to the address specified by the buyer in the order (when concluding the contract). ALL ORDERS ARE SENT AS REGISTERED MAIL - SIGN REQUIRED, with real price of the goods and shipping on the envelope. 

4.4 Packages are dispatched within a maximum of 5 working days from the date of payment. 

4.5 Delivery times are affected by the country to which the shipments are sent. Usually delivery times from the date of dispatch are 1-2 weeks to Europe, 2-4 weeks for the rest of the world. At busy times of the year such as for example around Christmas delivery times can extend to 6 weeks - these times depend on the delivery service, any extension is not caused by the seller.

4.5 By submitting an order, the Buyer agrees to the processing and delivery times. These delivery times are indicative and do not serve as a 100% binding delivery date. Exceeding any delivery time shall not entitle the buyer to compensation or the right to cancel the order or terminate the contract. In the event that the indicative delivery time is exceeded beyond a reasonable extent (twice the duration specified in the terms and conditions), the buyer shall be entitled to cancel the order or terminate the contract to the extent necessary. All amounts already paid will be refunded.

 

Article 5 Cancellations, complaints procedure and warranty information

5.1 Physical items - order cancellations are accepted by mutual agreement of both parties (seller and buyer), please contact us if you have any problems with your order.

5.2 Digital items (tutorials) - exchanges or cancellations are not accepted. Tutorials are for personal use only, not for a commercial purpose, all rights reserved.

 No copying, sharing, selling or teaching of my beading patterns, no selling finished beaded beads without my written permission.

5.3. If you need to make a claim, please contact us by email. If the claim is accepted, the goods will be replaced, if this is not possible, the money will be refunded. Complaints only apply to physical products and their defects. Please only send the goods back by prior arrangement, the address will be shared with you in an email communication.
